In consideration of the risk of injury while using, playing, practicing, tuning, or performing with an instrument, and as consideration for the right to participate in using, playing, practicing, tuning, or performing with an instrument, by using ChuckandSandi.com you, yourself, your heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all right’s claims or causes of action of any kind whatsoever arising out of my participation in using, playing, practicing, tuning, or performing with an instrument, and hereby release and forever discharge any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com located online at www.ChuckandSandi.com, their affiliates, managers, members, agents, attorneys, staff, volunteers, hers, representatives, predecessors, successors and assigns, for any physical or psychological injury, including by not limited to any injury or illness related to repetitive motion, any illness, paralysis, death, damages, economical or emotional loss, and you may suffer as a direct result of your participation in the aforementioned using, playing, practicing, tuning, or performing with an instrument including traveling to and from an event related to using, playing, practicing, tuning, or performing with an instrument.

By using ChuckandSandi.com and by following recommendations or instruction to use, play, practice, tune, or perform with an instrument, you are participating in using, playing, practicing, tuning, or performing with an instrument at your own risk. You are liable for being aware of the risks associated with traveling to and from ask well as participating in using, playing, practicing, tuning, or performing with an instrument which may include, but are not limited to, physical or or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), including by not limited to any injury or illness related to repetitive motion, death, damages, economical or emotional loss, and you may suffer as a direct result of your participation in the aforementioned using, playing, practicing, tuning, or performing with an instrument including traveling to and from an event related to using, playing, practicing, tuning, or performing with an instrument. You understand that these injuries or outcomes may arise from your own or others’ negligence, conditions related to travel, or the condition using, playing, practicing, tuning, or performing with an instrument locations(s) or on ChuckandSandi.com or to or at a private lesson. Nonetheless, you assume all related risks, both known or unknown to you, of your participation in using, playing, practicing, tuning, or performing with an instrument, including travel to, from and during private lessons or following instruction or the recommendations from ChuckandSandi.com.

By using ChuckandSandi.com you agree to indemnify and hold harmless any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by you or anyone on your behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by you or by anyone else acting on your behalf. If any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com incurs any of these types of expenses, you agree to reimburse any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com.

By using ChuckandSandi.com you acknowledge that using, playing, practicing, tuning, or performing with an instrument may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, teachers and instructors.

By using ChuckandSandi.com you acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com and all of its affiliates, managers, members, agents, instructors, teachers, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you otherwise have to bring a legal action against any of ChuckandSandi.com employees, agents, operators, and owners and assets of the owners of ChuckandSandi.com for personal injury or property damage.

To the extent that statute or law does not prohibit releases for negligence, this release is also for negligence on the part of any of ChuckandSandi.com employees, agents, operators, and owners of ChuckandSandi.com, and its staff.

In the event that you should require medical care or treatment, you agree to be financially responsible for any costs incurred as a result of such treatment. You are aware and understand that you should carry your own health insurance.

In the event that any damage to equipment or facilities occurs as a result of you or your families willful actions, neglect, or recklessness, you acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

Law and Jurisdiction

The Terms of Use are governed and should be construed in accordance to and with the laws of the state of Minnesota, USA, without regard to any conflicts of laws provisions. You agree that any disputes in connection with your use of ChuckandSandi.com or any web page, or this Terms of Use, and any enforcement thereof, shall be resolved in a federal or state court located in Hennepin County, MN.

Severability

In the event or occurrence that any provision of the Terms of use is deemed to be invalid or unenforceable by a court of competent jurisdiction, the section or sections determined to be invalid shall be considered stricken from the Terms of Use and the remainder of these Terms of Use shall remain in full force and effect.

Assignment

ChuckandSandi.com may assign the agreements or any part of them, and ChuckandSandi.com may delegate any of its obligations under the agreements. You may not assign the agreements or any part of them, nor transfer or sublicense your rights under the agreements, to any third party.

Entire Agreement

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and ChuckandSandi.com in relation to your use of ChuckandSandi.com and supersede all previous agreements in respect of such use.

Registrations, Authorizations and Breaches of These Terms of Use

Specific parts of ChuckandSandi.com may require you to register and provide information about yourself and where you do this you agree to provide true, accurate, complete and current information about yourself as prompted by the relevant registration form and to maintain up-to-date registration data by using your account on ChuckandSandi.com to update information that have changed.

ChuckandSandi.com use of registration data and certain other information about you is subject to ChuckandSandi.com’s Privacy Policy.

When you register on ChuckandSandi.com, you will choose a username/email address and password that gives you access to your website account. Recurring Payments, Memberships and Subscriptions

For your convenience Chuck and Sandi has automatic recurring payment plans when utilizing a Gold or Platinum Membership on Lessonpros.com. 

Customers purchasing a Gold Membership are signing up for access to Lesson Pro’s Lessons Library and will be charged an automatic subscription price to the customers method of payment each month until the customer chooses to cancel their subscription.

Customers purchasing a Platinum Membership are signing up for access Lesson Pros Lessons Library and will be charged a subscription price to the customers method of payment each year until the customer chooses to cancel their subscription.

Subscriptions and Cancellations to those subscriptions are subject to the Lessonpros.com Refunds and Subscriptions Cancellations Policy. The details of this policy can be found by clicking the link for the Refunds and Subscription Cancellations Policy here.

I (the customer of Lessonpros.com ) understand that Gold or Platinum Memberships automatically renew and it’s my (the customer’s) sole responsibility enter into an automatically renewing, automatically billing subscription. I (the customer of Lessonpros.com ) understand and assume all responsibility to manage and end the subscription should I (the customer) chose to at any time.
